Terms of Service

1. Introduction

Welcome to CavaRide. These Terms of Service ("Terms") govern your access to and use of the CavaRide website, mobile applications, and related services (collectively, the "Platform"). By creating an account, accessing the Platform, posting a ride, booking a ride, or otherwise using CavaRide, you agree to these Terms. If you do not agree, you must not use the Platform.

2. What CavaRide Is

CavaRide is a technology platform that connects drivers and passengers for cost-sharing journeys. CavaRide:

• Does not own or operate vehicles.
• Does not employ drivers.
• Does not provide transportation services.
• Is not a taxi company.
• Is not a common carrier.

Drivers and passengers enter into transportation arrangements directly with one another. CavaRide's role is limited to providing the Platform, payment processing integrations, communication tools, trust and safety features, and related services.

3. Eligibility

To use CavaRide, you must:

• Be at least 18 years old.
• Be legally capable of entering into binding agreements.
• Provide accurate and complete information.
• Maintain only one account unless expressly authorized.

You are responsible for maintaining the security of your account.

4. Driver Requirements

Drivers must:

• Hold a valid driver's licence.
• Be legally permitted to drive the vehicle used.
• Maintain legally required insurance.
• Ensure that their vehicle is roadworthy and complies with applicable laws.
• Provide truthful information about themselves, their vehicle, and their journeys.

Drivers are solely responsible for complying with all applicable laws and regulations.

5. Cost-Sharing Purpose

CavaRide is intended for cost-sharing journeys. Drivers agree that:

• Trips posted on CavaRide are journeys they already intend to make.
• Passenger contributions are intended only to help share travel costs.
• CavaRide may not be used to operate an unauthorized commercial passenger transport service.
• Drivers must not use the Platform to conduct taxi, chauffeur, or other for-hire transportation services unless legally authorized to do so.

When posting a ride, drivers may be required to confirm these statements.

6. Passenger Responsibilities

Passengers agree to:

• Arrive at agreed pickup locations on time.
• Behave respectfully.
• Follow reasonable safety instructions.
• Treat drivers, vehicles, and other passengers respectfully.
• Avoid conduct that may endanger others.

Passengers are responsible for ensuring they can safely participate in a trip.

7. Payments

Passenger payments are processed through Stripe and other supported payment providers. CavaRide does not store payment card information. By making a booking, passengers authorize payment of the displayed amount. Platform fees, where applicable, will be disclosed before payment.

8. Driver Payouts

Driver payouts are facilitated through Stripe Connect. Drivers may be required to complete identity verification and payout onboarding through Stripe. CavaRide does not collect or store:

• Bank account numbers
• IBANs
• Identity documents
• Tax identification information

These processes are handled directly by Stripe.

9. Cancellations and Refunds

Cancellations and refunds are governed by the CavaRide Refund & Cancellation Policy. Refund eligibility may depend on:

• Who cancelled
• When cancellation occurred
• Whether the trip was completed

CavaRide reserves the right to issue refunds where required by law or where necessary to resolve disputes.

10. Ratings and Reviews

Users may leave ratings and reviews after completed rides. Reviews must:

• Be truthful
• Be respectful
• Be based on actual experiences

CavaRide may remove reviews that are fraudulent, abusive, misleading, or otherwise violate these Terms.

11. Safety and Community Rules

Users must not:

• Harass others
• Threaten others
• Discriminate against others
• Commit fraud
• Impersonate another person
• Provide false information
• Use the Platform for unlawful purposes
• Engage in dangerous or reckless conduct

Users should immediately report safety concerns through available reporting tools.

12. Verification

CavaRide may offer verification features such as:

• Email verification
• Phone verification
• Payment verification
• Driver licence verification
• Stripe identity verification

Verification indicators are provided to improve trust but do not guarantee a user's identity, conduct, reliability, or safety.

13. User Content

Users retain ownership of content they submit. By submitting content to CavaRide, users grant CavaRide a non-exclusive licence to display, process, and use such content for operation of the Platform. Users must not upload content that is unlawful, abusive, infringing, or misleading.

14. Account Suspension and Termination

CavaRide may suspend or terminate accounts that:

• Violate these Terms
• Create safety risks
• Receive serious complaints
• Attempt fraud
• Circumvent Platform payments
• Misuse the Platform

CavaRide may investigate reported conduct and take action where appropriate.

15. Limitation of Liability

To the maximum extent permitted by law:

• CavaRide provides a technology platform only.
• CavaRide does not guarantee the conduct of any user.
• CavaRide does not guarantee the safety, quality, legality, or reliability of any trip.
• Users participate in rides at their own risk.

Nothing in these Terms excludes rights that cannot be excluded under applicable law.

16. Indemnification

Users agree to be responsible for claims, losses, damages, and liabilities arising from:

• Their use of the Platform
• Their conduct during rides
• Their violation of these Terms
• Their violation of applicable laws

17. Privacy

Personal information is processed in accordance with the CavaRide Privacy Policy. By using the Platform, users acknowledge that their information may be processed as described in the Privacy Policy.

18. Changes to These Terms

CavaRide may update these Terms from time to time. Material changes will be communicated through the Platform or by other appropriate means. Continued use of the Platform after changes become effective constitutes acceptance of the updated Terms.

19. Governing Law

These Terms shall be governed by the laws of Finland. Any disputes shall be resolved in accordance with applicable Finnish law.
